Terms of Service

These Terms of Service govern your use of fivetowers.us and your engagement with Five Towers Media for website design, hosting, maintenance, and SEO/GEO management services. By accessing this website or engaging our services, you agree to these terms.

Please note: These Terms apply to both website visitors and clients who engage Five Towers Media for services. Project-specific terms, pricing, and deliverables are governed by the proposal or service agreement provided at the start of each engagement.

1. About Five Towers Media

Five Towers Media is a website agency located at 63 Putnam Street, Suite 202, Saratoga Springs, NY 12866. We provide website design and build, managed hosting, website maintenance, and SEO/GEO management services to small and mid-size businesses.

2. Use of This Website

You may use fivetowers.us for lawful purposes only. You agree not to:

  • Use this website in any way that violates applicable federal, state, or local laws or regulations
  • Attempt to gain unauthorized access to any portion of this website or its related systems
  • Transmit any unsolicited or unauthorized advertising or promotional material
  • Introduce any malware, viruses, or other harmful code
  • Scrape or harvest content from this website without prior written consent

3. Services

Website Design & Build. All website builds are scoped and priced via a written proposal. Work begins upon receipt of a signed proposal and deposit. Timelines are estimates and depend on client responsiveness and feedback. Five Towers Media retains the right to display completed work in our portfolio unless otherwise agreed in writing.

Managed Hosting. Hosting plans are billed quarterly. All plans are month-to-month — no long-term contracts are required. Hosting may be cancelled with 30 days written notice. Five Towers Media is not responsible for data loss resulting from client-initiated cancellations. Clients are responsible for maintaining their own backups outside of those included in their hosting plan.

Website Maintenance. Maintenance services are included in Essentials and Advanced hosting plans. Hours included in each plan are for client-requested content updates and related tasks. Hours expire monthly and do not roll over. Overage work is billed at $115/hr. Five Towers Media will notify the client before any overage work begins.

SEO/GEO Management. SEO and GEO management is a month-to-month service. Results are not guaranteed — search visibility improvements depend on many factors outside of Five Towers Media’s control, including algorithm changes, competition, and client content. Cancellation requires 30 days written notice.

4. Payment Terms

Payment terms are specified in each project proposal or service agreement. General terms are as follows:

  • Website builds typically require a deposit before work begins, with the balance due at or before launch
  • Hosting, maintenance, and SEO/GEO plans are billed quarterly in advance
  • Overage hours are invoiced separately and due upon receipt
  • Invoices unpaid after 30 days may result in service suspension

5. Client Responsibilities

Clients are responsible for providing accurate information, timely feedback, and necessary access (CMS, GSC, GBP, etc.) required to deliver services. Delays caused by client inaction may affect project timelines. Five Towers Media is not liable for service delays resulting from a client’s failure to provide required materials or approvals.

6. Intellectual Property

Client content. You retain ownership of all content, logos, images, and materials you provide to Five Towers Media. By providing these materials, you represent that you have the right to use them and grant us a license to use them in connection with your project.

Deliverables. Upon receipt of final payment, clients own the finished website deliverables. Five Towers Media retains the right to display completed work as portfolio examples unless a written non-disclosure agreement is in place.

Five Towers Media content. All content on fivetowers.us — including text, design, graphics, and code — is the property of Five Towers Media and may not be reproduced without written permission.

Third-party tools. Websites built by Five Towers Media may include third-party plugins, themes, or tools governed by their own licensing terms. Clients are responsible for maintaining applicable licenses after project handoff.

7. Confidentiality

Five Towers Media treats all client information shared during the course of an engagement as confidential. We do not share client business information, project details, or communications with third parties without client consent, except as required by law or to deliver the agreed services (e.g., hosting infrastructure providers).

8. Limitation of Liability

Five Towers Media’s liability for any claim arising from our services is limited to the total fees paid by the client in the three months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including but not limited to lost profits, lost data, or business interruption.

We are not responsible for third-party service outages, plugin failures, or issues arising from software or platforms outside our direct control (including WordPress core, hosting infrastructure, or Google services).

9. Disclaimer of Warranties

This website and our services are provided “as is” without warranties of any kind, express or implied. Five Towers Media does not warrant that this website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee specific search ranking results or AI citation outcomes from our SEO/GEO management services.

10. Termination

Either party may terminate a service engagement with 30 days written notice unless otherwise specified in a project agreement. Five Towers Media reserves the right to suspend or terminate services immediately in cases of non-payment, abusive conduct toward staff, or use of our services for unlawful purposes.

Upon termination of hosting services, clients have 30 days to migrate their site. After 30 days, Five Towers Media is not responsible for preserving site data.

11. Governing Law

These Terms of Service are governed by the laws of the State of New York. Any disputes arising from these terms or from engagement with Five Towers Media shall be resolved in the state or federal courts located in Saratoga County, New York. You consent to the jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of this website or our services after changes are posted constitutes acceptance of the updated terms. For active service clients, material changes will be communicated by email.

13. Entire Agreement

These Terms of Service, together with any signed project proposal or service agreement, constitute the entire agreement between you and Five Towers Media. They supersede all prior discussions, representations, or agreements.
